1.0 Introduction

Creative Remedies is a professional networking website that gives you the chance to create a profile for you or your organisation, upload and maintain your own content, pictures and text and invite other users to view your profile. Users of Creative Remedies may view all users pages and profiles. However, until you become a registered user certain networking functions are not available to you. The following are standard terms and conditions that protect the user (you) and the organisation responsible for the maintenance and upkeep of Creative Remedies (Staffordshire Arts & Museum Service - a Department of Staffordshire County Council). By reading these terms and conditions, you agree to abide by the guidelines outlines. You can only complete your registration if you read and tick the agreement to terms and conditions box.

These T&C maybe amended at anytime and it is your responsibility as a user to ensure you are aware of any changes.

2.0 Eligibility

Registered User must be over the age of 16. By registering on Creative Remedies, you confirm that you are 16 or older and that you have the capacity to understand, agree to and comply with these Terms & Conditions. You should provide true, accurate and complete registration information to become a ' Member ' . As part of the registration process, you will be asked to select a username and password and you will be responsible for all activities occurring under your username and for keeping your password secure. We may refuse to grant you a username that impersonates someone else, is or may be protected by trademark or proprietary rights law, or is vulgar, offensive or otherwise inappropriate, as determined by us in our sole discretion.

3.0 Conduct & Appropriate content

You are solely responsible for your conduct and any data, text, information, graphics, photos, profiles, audio and video clips, links and other content ( ' Materials ' ) that you submit, post, and display on the Creative Remedies site.

We may, but shall have no obligation to, remove Materials that we determine are unlawful, fraudulent, threatening, libelous, defamatory, obscene or otherwise objectionable, or infringes or violates any party ' s intellectual property or other proprietary rights or these Terms of Conditions. Photographic content you post on the site (especially depicting minors or vulnerable adults) requires you to gain the consent of those depicted). If a dispute regarding consent from individuals occurs, Creative Remedies may ask you for written proof of such consent. If you cannot provide this, we reserve the right to remove the image.

We also reserve the right to reject, refuse to post or remove any posting (including private messages) by you, or to restrict, suspend, or terminate your access to all or any part of the Creative Remedies site for any reason, with or without prior notice, and without liability. International members agree to abide by local ( United Kingdom ).

4.0 Copyright

You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. Creative Remedies does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, or any other materials (collectively, "Content") that you post on Creative Remedies. After posting your content you continue to retain all ownership rights in such content, and you continue to have the right to use your Content in any way you choose.

By displaying or publishing ("posting") any Content on or through Creative Remedies, you hereby grant to Creative Remedies a limited license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content solely on and through Creative Remedies

Without this license Creative Remedies would be unable to provide services. For example, without the right to modify Member Content, Creative Remedies would not be able to digitally compress image files that Members submit or otherwise format Content to satisfy technical requirements,

4.1 Reproduction of Content and Images

Please note that copyright on specific content contained within these websites remains with Staffordshire County Council and other copyright owners as specified. In terms of artistic works, if the artist is alive, or has been dead for less than 70 years, there will be a separate copyright in the work itself which is additional to the copyright in the photographic reproduction.

If you wish to reproduce any images of works featured on this site, you should in the first instance contact Creative Remedies to be directed to the photographic copyright holder. Where necessary, you will then be required by international copyright law to clear the copyright in the art work with the appropriate rights holder.

It is your responsibility to obtain permission from copyright holders or their agents before a reproduction of works or other content is made, or this will constitute an infringement of copyright.

Creative Remedies is not responsible for any incorrect or inaccurate Content posted on the website. Profiles created and posted by Members of the Creative Remedies Website may contain links to other websites. Creative Remedies is not responsible for the Content, accuracy or opinions expressed on such websites, and such websites are in no way investigated, monitored or checked for accuracy or completeness by us. Inclusion of any linked website on the Creative Remedies website and does not imply approval or endorsement of the linked website by us.

Creative Remedies is not responsible for the conduct, whether online or offline, of any User and Members are reminded of the strict guidelines outlined in section 2.

Creative Remedies is not responsible for any connection or access to the Creative Remedies website by you or the quality of the transmission of any information passing between you and the website. You will be responsible for providing your own communications equipment to access the Bebo.com website via the Internet, and the Internet access charges thereon.

6.0 Commercial Use by Members

The Creative Remedies Services are for the personal use of Members only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by Creative Remedies. Illegal and/or unauthorized use of Creative Remedies Services, including collecting usernames and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the Creative Remedies Website is prohibited. Commercial advertisements, affiliated links, and other forms of solicitation may be removed from Member profiles without notice and may result in termination of Membership privileges.

7.0 Privacy Policy

We take your privacy very seriously. The personal information gathered about you in your registration is for the sole use of Staffordshire Arts & Museum Service (administrators of the Creative Remedies site). We will not divulge, share or disclose this information to any other parties (unless we find ourselves legally obliged to do so). At times we shall use your contact email details to send you relevant information about our activities that we hope may be of interest to you and in agreeing to the T&C, we understand we have your consent to do so.

8.0 Member Disputes.

You are solely responsible for your interactions with other Creative Remedies.com Members. Creative Remedies reserves the right, but has no obligation, to monitor disputes. You may, however, inform the Creative Remedies administrator at any time of actions, content or material that breaches the guidelines set out in this document

9.0 Termination of the Creative Remedies Service

These Terms & Conditions will apply to your use of the Creative Remedies website. At any time, you can terminate your account which will remove your profile and other personal information from view. We may terminate your membership immediately and will endeavor to give you suitable notice in these circumstances

(b) Conditions of Use

You agree to abide by all applicable local, state, national and international laws and you agree NOT to:

• Defame, abuse, harass, stalk, threaten or otherwise violate the rights (such as rights of privacy and publicity) of others.
  
• Publish, distribute and/ or disseminate any harmful, obscene, indecent, unlawful, libelous, profane, defamatory, infringing, inappropriate, hateful, or racially, ethnically or otherwise objectionable material or information.
  
• Use other Members ' personal data for purposes other than establishing contact that is reasonably expected to be welcomed by such other Members
  
• Submit Materials that are unlawful or promote or encourage illegal activity or that would violate the property rights of others.
  
• Submit Materials of any third party without such third party ' s prior written consent, or Materials that falsely express or imply that such Materials are sponsored or endorsed by Bebo.com
  
• Create a false or misleading identity or falsely state or otherwise misrepresent your affiliation with a person or entity, for the purpose of misleading others as to the identity of the sender or the origin of a message or to harvest or otherwise collect information about others.
  
• Transmit, email or post any material that contains in any form software viruses or such programs as including but not limited to, Trojan horses, worms, time bombs, cancel-bots, computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
  
• Use the Creative Remedies web site in any unlawful manner or in any other manner that could damage, disable, overburden or impair the website.
  
• Attempt to gain unauthorised access to the Creative Remedies Website, other accounts, computer systems or networks, through password mining or any other means.

• Interfere with another Member ' s use and enjoyment of the Creative Remedies site.
  Harvest or collect email addresses or other contact information of Members, including usernames by electronic or other means.
